As we all know, primaries in Pennsylvania are what are referred to as “closed primaries” because only registered voters of that political party are permitted to vote for that party’s candidates.
But that doesn’t mean that individuals registered in other political parties are foreclosed from being able to help candidates, running under a different platform, with whom they agree.
This Primary isn’t just for Republicans, it’s for every Pennsylvanian who cares about justice!
Let’s be honest, there is FAR more that unites us than divides us.
The media and the political parties themselves would have us believe that we’re at polar opposite sides of the spectrum, but in reality, we aren’t. While certain issues resonate more with certain voters of particular political parties, we truly are far more centrist than the media or the political parties want us to believe.
Unfortunately, in Pennsylvania, judicial candidates are forced to declare a political platform in order to run. Resultantly, the races have become extremely political, with obscene amounts of money being dumped into them, because of the politics involved.
While I have spoken numerous times about the need for the General Assembly to modify the law and preclude any judicial candidate from running under any political party, reinforcing impartiality, that isn’t the purpose of this article.
Rather, the purpose is to remind everyone, regardless of political affiliation, to truly vet the candidates and make a decision, not based on political affiliation, but based on judicial temperament and whom you believe would be the best judge.
As I’ve previously discussed, judicial temperament is more than an individual’s demeanor; it’s about fairness, humility, impartiality, consistency, ethics, and a deep respect for the law and for every person who comes before the court. It means not weaponizing the law to punish others, and not placing oneself above the law. It means applying the law as it is written—but also asking the right constitutional question: Is the law itself lawful?
And some may try to argue that it is next to impossible to determine the judicial temperament of a non-judge candidate; however, I believe a candidate’s litigation history reflects almost everything about one’s judicial temperament.
For example, in turning to fairness, impartiality, and deep respect for the law, does the candidate stand up for what is just and fair in cases? Does he argue that the Government is not above the law and must be held accountable to the law, no different than the citizens? If so, the candidate’s track record reflects someone who will likely be fair. And if such is reflected throughout the candidate’s litigation history, it shows consistency. For ethics, have they had any substantiated complaints? Or, when litigating a matter, have they disclosed contrary precedent to their arguments and attempted to distinguish it or argue why the precedent was decided in error? And I could go on and on…
